Traffic violations and auto accidents are among the most common legal issues Canadians face. A single ticket can increase your insurance premiums, add demerit points to your licence, and in serious cases, lead to a licence suspension. When accidents occur, the legal consequences can be even more significant. Having access to a traffic lawyer ensures you understand your rights and have professional representation when it matters most.

Common Traffic Violations in Canada

Traffic laws in Canada are enforced at the provincial level, meaning the specific rules, penalties, and procedures vary depending on where you are driving. Common traffic violations include speeding, running a red light or stop sign, distracted driving (including mobile phone use), improper lane changes, failing to signal, following too closely, and driving without valid insurance or registration.

Even a minor violation can have lasting consequences. Accumulated demerit points can lead to licence suspension, and traffic convictions appear on your driving record, which insurers use to set your premiums.

How a Traffic Lawyer Can Help

A traffic lawyer can defend you against moving traffic violations, advise on the most effective strategy for resolving your ticket, and represent you in court. In many cases, a lawyer can negotiate a reduction in charges or penalties, saving you money on fines and insurance increases.

Traffic Ticket Assistance

With a Personal Legal Service Plan, you receive assistance for non-criminal moving traffic citations received while driving a properly licensed, registered, and insured motor vehicle with the owner's consent.

Coverage varies by plan. The Basic Plan covers 1 ticket per year for each covered member, with a $79 court appearance fee and a 90-day waiting period. The Preferred Plan covers 2 tickets per year for each covered member, allows 1 unused service to roll over (up to a maximum of 3 tickets), and has only a 10-day waiting period. The Premium Plan covers 3 tickets per year for each covered member, allows 2 unused services to roll over (up to a maximum of 5 tickets), and also has a 10-day waiting period.

Tickets must be submitted to the Provider Law Firm at least five business days before the appearance date. You may need to attend court hearings if requested by your lawyer.

What Is Not Covered

Traffic ticket assistance does not cover out-of-province tickets, matters that will not adversely affect your driving or motor vehicle record, pre-existing events, matters involving vehicles driven for income-producing purposes, misdemeanour or felony charges, or allegations of driving under the influence.

Auto Accidents and Legal Protection

Auto accidents can range from minor fender benders to serious collisions with significant legal and financial consequences. A lawyer can help you understand your rights following an accident, deal with insurance companies, pursue or defend against damage claims, and navigate the legal process if a lawsuit is filed.

Criminal Defence for Death-Related Traffic Accidents

In the most serious cases, Personal Legal Service Plans include advice, consultation, and representation for specific criminal charges arising from traffic accidents involving a death. This includes charges such as manslaughter, involuntary manslaughter, negligent homicide, or vehicular homicide, provided the accident occurred while driving a properly licensed, registered, and insured vehicle with the owner's consent.

This coverage excludes pre-existing events, income-producing vehicle use, hit and run incidents, leaving the scene of an accident, and allegations of driving under the influence of alcohol, intoxicants, controlled substances, chemicals, or medicines.

General Legal Advice for Drivers

Beyond specific incidents, all plan members have access to a Dedicated Provider Law Firm for answers on an unlimited number of personal legal matters—including questions about your driving record, licence status, insurance disputes, and more. You can schedule a consultation or request a callback within eight business hours.

Available Across Canadian Provinces

Traffic laws, penalties, and court procedures vary by province. Legal Service Plans are available in Alberta, British Columbia, Manitoba, Ontario, and Saskatchewan, connecting you with lawyers experienced in the traffic and motor vehicle laws of your specific jurisdiction.

Do Not Let a Traffic Ticket Cost You More Than It Should

A single traffic ticket can lead to higher insurance premiums, demerit points, and a blemished driving record. With a Personal Legal Service Plan, you have a traffic lawyer ready to defend you, protect your record, and minimise the financial impact. Legal protection for Canadian drivers is affordable, accessible, and ready when you need it.
